In August 2002, a letter was issued advising that Board staff would be coordinating a working group to consider stakeholder input regarding concerns associated with consumer security deposit policies of electricity distributors ("LDCs") across Ontario. The working group, which was comprised of consumer and LDC representatives, provided recommendations including a common set of terms and conditions for security deposits. On June 10, 2003, the Board initiated a proceeding to obtain input from all interested persons. In response to the submissions received, the Board made a number of changes to the proposed amendments and requested further input on November 10, 2003.

On March 29, 2005, as part of a separate subsequent proceeding (Unpaid Electricity Charges), the Board issued further amendments to the Distribution System Code which provided clarification to electricity distributors on their rights and obligations in the areas of security deposits (as well as tenant arrears and reconnection charges).

On May 12, 2006, the Board amended the Distribution System Code such that bulk-metered residential condominiums will be treated as residential customers for security deposit purposes. The May 12th Notice noted that once a self-declaration form has been approved, it would be provided to each electricity distributor to post on its website and it would also be posted on the Board's website.

The Board is initiating, on its own motion, a proceeding to obtain broad input on proposed changes to the Distribution System Code. New proposed provisions have been added with the intent to increase consistency amongst Ontario electricity LDCs in terms of their treatment of consumers with respect to security deposit requirements.
