The Energy Consumer Protection Act, 2010 (ECPA), which came into force on January 1, 2011, established a new framework for the regulation of the activities of licensed electricity retailers and gas marketers (suppliers). 

Certain of the Board’s existing regulatory instruments applicable to the activities of suppliers were aligned with the ECPA, and new rules were developed in the context of the enhanced consumer protection environment inherent in the ECPA.

The Board has posted the Board-approved Disclosure Statements and the pre-populated Price Comparison templates which are to be used for new contracts and contract renewals with low-volume consumers that are effective on and after January 1, 2011.

The Board has issued a letter to electricity retailers and gas marketers regarding their new conditions of licence under the Energy Consumer Protection Act, 2010.

The Board has issued a letter to stakeholders in relation to the implementation of the Energy Consumer Protection Act, 2010 that addresses issues relating to the availability and use of price comparison templates and disclosure statements, as well as the acknowledgement of certificates of compliance.

The Board has issued its final Notice adopting a restated Electricity Retailer Code of Conduct, a restated Code of Conduct for Gas Marketers and an amendment to the Gas Distribution Access Rule, together with verification call scripts, renewal/extension call scripts, disclosure statements and price comparison templates. The new regulatory requirements implement the consumer protection (retailer/marketer) provisions of the Energy Consumer Protection Act, 2010 and come into force on January 1, 2011.

The Board has issued a letter to the Ontario EBT Standards Working Group for Retail Settlement and the GDAR EBT Standards Working Group to request that the EBT Standards Working Groups identify any issues related to the current EBT processes arising from the implementation of the ECPA, and in particular from the final regulations as filed and the revised proposed revisions to the Board’s regulatory instruments.
