In 2004, under section 79.16 of the Ontario Energy Board Act, 1998, the Ontario Energy Board (OEB) developed an electricity price plan that provides stable and predictable electricity pricing, encourages conservation and ensures the price consumers pay for electricity better reflects the price paid to generators. The Regulated Price Plan (RPP) has been in place since 2005. RPP prices, which appear on the Electricity line of eligible customer bills, are set based on a forecast of how much it will cost to supply electricity to RPP consumers over the next 12 months. RPP prices are reviewed once a year and are reset as required to recover the cost of electricity supply.

RPP prices that were in effect from July 2017 to October 31, 2019 were set by the OEB under the Ontario Fair Hydro Plan Act, 2017. Under that Act, bill relief was provided through a reduction in the electricity prices that appear on the Electricity line of customer bills.

The OEB resumed setting RPP prices under section 79.16 of the Ontario Energy Board Act, 1998, effective November 1, 2019.

Electricity distributors and other regulated entities are reminded that the fixed pricing of 8.5 ¢/kWh for Regulated Price Plan (RPP) consumers will expire at the end of the day on February 22, 2021. At the beginning of the day on February 23, 2021, and RPP consumers will return to Time-of-Use and Tiered pricing at the RPP prices set by the OEB on December 15, 2020.

The OEB has issued a new edition of the Regulated Price Plan Manual. Revisions reflect renewed objectives in the OEB’s Regulated Price Plan Roadmap issued in November of 2015. This version also incorporates changes to the steps taken when a significant unexpected variance accumulates. Other changes have been made to acknowledge developments in Ontario’s electricity sector since 2013, when the manual was last updated.

December 23, 2013

The Board posted a report prepared by Navigant Consulting Inc., “Time-of-Use Rates in Ontario – Part 1: Impact Analysis." The report estimates the response of the residential and small commercial and industrial customers under the Regulated Price Plan that were transitioned from tiered rates to Time-of-Use (TOU) rates.

Part 2 of the TOU analysis will examine several different TOU structures and pricing regimes and estimate the impacts on consumer electricity demand and system-wide impacts of these regimes. Part 2 of the analysis is expected to be published in the first quarter of 2014.

The Board has approved revisions to the RPP Manual to come into effect on January 1, 2014. These revisions change the way that the Final Variance Settlement Amount (“FVSA”) is calculated for consumers that leave the regulated price plan (“RPP”), and apply to consumers that depart the RPP on and after January 1, 2014. The FVSA for a consumer that leaves the RPP before January 1, 2014 is to be calculated in accordance with the August 22, 2011 version of the Manual.

August 23, 2011

The Board has issued a revised Regulated Price Plan Manual (“RPP Manual”) that now reflects changes in law that have occurred since the RPP Manual was last revised in July 2009.

The revisions to the RPP Manual relate principally to the following changes in law that were in effect when the Board set RPP prices for the May 1 to October 31, 2011 period:

  1. Changes to the global adjustment mechanism resulting from amendments to Ontario Regulation 429/04 (Adjustments under Section 25.33 of the Act) that came into effect on January 1, 2011.  These are (i) the manner in which the global adjustment is allocated to different classes of consumers; and (ii) the inclusion in the global adjustment of amounts approved by the Board for Board-approved conservation and demand management programs undertaken by electricity distributors. 
     
  2. The change in the time at which the off-peak period starts on weekdays (7 p.m. throughout the year) effective May 1, 2011, in accordance with amendments to Ontario Regulation 95/05 (Classes of Consumers and Determination of Rates). 

A number of minor revisions have also been made to update the RPP Manual to reflect changes in terminology and the like.

The Board has issued a revised Regulated Price Plan Manual that incorporates changes announced by the Board in its letter of May 13, 2009, as well as references to econometric modeling in relation to the setting of time-of-use prices. The revisions also include changes designed to more generally update the Manual to:  (a) reflect changes in law, evolution in the marketplace and other relevant developments that have occurred since this Manual was originally issued in March 2005; and (b) reflect the fact that the processes and methodologies described in this Manual have now been in use by the Board for a number of years. These latter changes affect, among other things, the information basis upon which the Board sets Regulated Price Plan prices, but do not otherwise affect in a substantive way the manner in which the Board sets those prices.

Ontario Regulation 115/09, filed on March 27, 2009, amends Ontario Regulation 95/05 (Classes of Consumers and Determination of Rates) by: 

i. extending eligibility for the RPP for all low volume and designated consumers until November 1, 2009; and
ii. enabling those consumers that will cease to be eligible for the RPP on November 1, 2009 to opt out of the RPP in the interim period regardless of whether or not they have an interval meter.

August 14, 2006

On July 28, 2006, the Board amended the Standard Supply Service Code to allow electricity distributors to implement new pilot projects relating to time-of-use commodity prices. The Board's accompanying July 28th Notice only referenced one written submission. In fact, the Board received eight written submissions in relation to the July 12, 2006 proposed amendments. The Board has therefore issued a further letter which addresses the issues raised in all of the submissions. The amendments to the SSS Code that were made by the Board, and came into effect on, July 28, 2006 remain unchanged.
